Latitude83 Terms of Service

Version 2026-09-22 · Laws of England and Wales

Read the Privacy Notice

1. Who we are and the agreement

These terms govern access to the Latitude83 website, customer portal and associated online training, classroom, analytics and Casey AI services supplied by Latitude83 Ltd (Latitude83, we, us). You means the individual using an account; organisation means the employer or other organisation for which access is provided. Separate application, device and third-party terms may also apply.

By expressly accepting these terms, you agree to the account-use obligations that apply to you. If you are authorised to enter into an agreement for your organisation and do so, you confirm that authority. An employee's permission to use an account does not by itself give them authority to purchase services or bind their organisation to a commercial agreement.

A separately signed customer agreement takes precedence over these terms to the extent of a conflict. A signed data processing agreement takes precedence on data protection matters. These terms do not retrospectively vary a signed contract. The services are intended for organisational and professional use. Mandatory rights that cannot lawfully be excluded remain unaffected.

2. Accounts and organisational authorisation

You must provide accurate account information, use only the organisation and permissions assigned to you, and maintain your organisation's authorisation throughout your use. Do not impersonate another person, use another person's credentials or access records outside your authorised role. Tell your administrator promptly if your role or authority changes.

Keep credentials secure, use available security controls and report suspected compromise promptly through portal support or your existing Latitude83 contact. Administrators must manage invitations, permissions and leavers responsibly. Do not share named user accounts. An organisation is responsible for managing its authorised users to the extent provided by its customer agreement.

3. Prototype and evaluation status

The portal and features identified as prototype, beta, preview or trial are under development. They may contain defects, inaccurate or incomplete results, incompatible changes, interruptions, delayed synchronisation or data loss. Features and interfaces may change, be withdrawn or require updates. An evaluation is not a promise of a future feature, launch date or production service level.

Assess suitability before use, supervise evaluation activities and keep independent copies of important training and compliance records. Do not use a prototype as the sole repository of required records or as a dependency for safety-critical operations. No uninterrupted availability, error-free operation or fitness for a particular operational purpose is promised except where expressly agreed in writing. This does not exclude any obligation or liability that the law does not permit us to exclude.

4. Aviation training and safety

The services provide training aids, simulations and administrative support. Unless separately confirmed in writing with the relevant scope of approval, they are not regulatory certification, an approved training programme, an aircraft operating manual or an instruction for a live emergency. Do not use them to direct live aircraft operations or emergency response.

Your organisation remains responsible for verifying content against the applicable aircraft configuration, current manufacturer documentation, approved operating procedures and regulatory requirements; providing qualified instructors; and determining whether training and assessment meet its obligations. If content conflicts with an approved procedure, stop relying on that content and report it.

Automated scores, attempt histories, progress bars and AI summaries may be incomplete or incorrect. A pass is not certification of competence; a failure is not by itself evidence of incompetence. Qualified personnel must review relevant evidence before making consequential training, employment or safety decisions. Follow device safety instructions and provide a suitable supervised environment when using simulations or VR.

5. Casey AI and human review

Casey is an AI assistant, not a human instructor, regulator or professional adviser. It may generate plausible but incorrect, biased, incomplete or out-of-date answers, including incorrect procedural steps or references. Independently check outputs against authoritative sources before acting. Do not rely on Casey for operational, legal, medical or other safety-critical decisions.

Casey interactions, generated responses and associated usage or diagnostic records may be logged and reviewed by authorised personnel for support, security, abuse prevention, troubleshooting and quality assurance, as explained in the applicable Privacy Notice and customer data arrangements. This does not mean every interaction is monitored, nor does it create an emergency-monitoring service.

Do not submit names, email addresses, User IDs, passenger details, health information, disciplinary records, passwords, access tokens or other personal, sensitive or confidential information to Casey unless explicitly permitted by an approved arrangement. Use anonymised examples where possible; removing a name alone may not make information anonymous. Only upload materials you are authorised to disclose and process.

Acceptance of these terms is not blanket consent to personal-data processing, marketing, AI model training or unrestricted staff access. Any separately approved model-development use is limited to Latitude83 models, not external providers' own models, and requires the arrangements described in the Privacy Notice. Applicable data protection law continues to apply. Report accidental disclosures promptly and stop further submission.

6. Acceptable use

Use the services lawfully and within your permissions, subscription and agreed purpose. Do not upload unlawful or malicious material; harass others; infringe intellectual property or confidentiality; attempt to bypass access controls, trials or usage limits; interfere with availability; or test security without written authorisation.

Do not scrape, resell, redistribute, reproduce or use Latitude83 content to train another AI system without permission, except as expressly licensed or permitted by law. Do not reverse engineer the services except to the extent mandatory law permits. Report vulnerabilities privately through the agreed support channel; do not exploit them or access other organisations' data.

7. Content, intellectual property and confidentiality

Latitude83 and its licensors retain rights in their software, models, scenarios, design, documentation and other materials. Your organisation receives only the limited rights granted by its subscription or written agreement for authorised internal use. No ownership is transferred by access or payment.

You and your organisation retain your existing rights in materials you supply. You must have the rights and lawful basis needed to supply them. You authorise Latitude83 and its contracted providers to process those materials only as necessary to deliver and support the agreed services, subject to applicable confidentiality and data protection arrangements. These terms do not grant a general right to publish your confidential information or train general-purpose AI models on it.

Each party must protect the other's non-public business information with reasonable care, use it only for the agreed purpose and disclose it only to people or providers who need it and are subject to appropriate obligations, or where legally required. This does not cover information independently developed, lawfully received without restriction or already public without breach.

8. Data protection and records

Our separate Privacy Notice explains the personal information processed, purposes and lawful bases, recipients, international transfers, retention and individual rights. Where Latitude83 processes training data on an organisation's behalf, the applicable data processing agreement sets out those responsibilities. Your organisation must provide appropriate notices to its staff and other affected individuals and ensure its instructions and supplied data are lawful.

Provide only information necessary for the service and use designated fields rather than AI prompts for authorised account and training records. Neither this agreement nor an instruction to avoid personal information removes anyone's statutory data protection duties.

We record the account identifier, accepted document version, acceptance time and the confirmations given to evidence acceptance. No marketing consent is requested through this process. Requests concerning personal data must be handled under the applicable Privacy Notice, not treated as a waiver of rights.

9. Trials, subscriptions and third-party services

Trial access lasts until the agreed expiry date and may be subject to device, feature, request or usage limits. Unless a different time is stated, a trial end date displayed by the portal is inclusive and expires at the following midnight in UK time. Expiry may block portal features, new AI requests and online device connections. It does not necessarily disable previously downloaded offline content or erase stored records.

A trial does not automatically become a paid subscription unless an authorised representative expressly agrees to that arrangement. Fees, taxes, payment terms, renewal and cancellation for paid services are governed by the applicable order or customer agreement. Do not assume that an ordinary account holder is authorised to incur charges for their organisation.

Cloud services, AI providers, networks, browsers, operating systems and devices may affect availability or results. Third-party services may have separate terms. References to third-party dependencies do not remove our own contractual or statutory responsibilities.

10. Suspension, termination and changes

We may proportionately restrict or suspend access where reasonably necessary to address security threats, unlawful use, material breach, expired access or legal requirements. We will give notice and an opportunity to resolve a remediable issue where reasonably practicable; immediate action may be needed for urgent risks. We may terminate for an unremedied material breach subject to any overriding customer agreement.

When access ends, stop using the affected services and materials except as an agreement or law permits. Data export, retention and deletion are governed by the customer agreement and Privacy Notice; suspended access does not mean immediate deletion. Arrange any required exports before a known trial or subscription expiry.

Material changes to these terms will be identified with a new version and presented for fresh acceptance before further portal use. Changes do not retrospectively remove accrued rights. If you do not agree, do not accept; sign out and ask your organisation's administrator or Latitude83 contact to discuss the position.

11. Liability

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited. Mandatory statutory rights and remedies remain unaffected.

Subject to the preceding paragraph, and only to the extent lawful and reasonable in the circumstances, Latitude83 excludes liability for indirect or consequential losses and for loss of anticipated profits, revenue, business opportunities, goodwill or anticipated savings arising from use of the services. This does not mean that every loss of these types is legally indirect, nor does it exclude liability where doing so would be unlawful or unreasonable.

Any monetary liability cap must be expressly set out in the applicable signed customer agreement. These terms do not impose unlimited personal liability on individual employees. The prototype warnings describe material limitations but do not operate as a blanket exclusion of responsibility for negligence or data protection obligations.

You must take reasonable steps to avoid and mitigate loss, including independent verification and maintaining appropriate backups. We remain responsible for our own obligations; you are not required to indemnify us for our own negligence or wrongdoing.

12. General terms and disputes

The laws of England and Wales govern these terms and related non-contractual obligations. Subject to any mandatory rights or overriding signed agreement, the courts of England and Wales have exclusive jurisdiction. The parties should first seek to resolve concerns in good faith through their usual support or contractual contacts.

If a provision is unenforceable, the remainder continues so far as legally possible. A delay in enforcing a right is not a waiver. No person other than the parties has rights under the Contracts (Rights of Third Parties) Act 1999 unless a signed agreement expressly provides otherwise. These terms do not exclude liability for fraudulent representations or override an agreed written customer contract.
